Refund & Cancellation Policy

This Refund & Cancellation Policy describes how Top3 LLC, a Utah limited liability company ("Top3," "we," "us," or "our"), handles subscriptions, cancellations, refunds, failed payments, and chargebacks for all paid plans offered through top3.cloud (formerly mappack.cloud). This Policy is incorporated into our Terms of Service.
Overview
Top3 is a month-to-month subscription service offered in three plans: SEO ($497/mo, Google Map Pack only), AEO ($497/mo, AI answer-engine citation only), and Both ($797/mo, Map Pack + AEO). You may cancel at any time. We do not offer prorated refunds for unused portions of a billing period. All Top3 plans use a billing-on-result model: no credit card is required at signup, and you are not charged at any point unless and until any 1 of your 5 keywords wins on the surface you purchased — for SEO plans, reaching position 1–3 in the Google Map Pack; for AEO plans, being cited by name in ChatGPT, Gemini, or Perplexity for a query tied to your keywords; for the Both plan, the first event of either type — and you have completed the verification and billing-notice windows. Subscription Terms
- Billing cycle: Once billing begins, charges recur monthly on the calendar day of the first charge (i.e., 14 calendar days after the billing-notice email per the billing sequence described below).
- Auto-renewal: Subscriptions renew automatically each month unless cancelled before the next billing date.
- Currency: All charges are in United States Dollars (USD).
- Taxes: Prices exclude applicable taxes. Taxes, where required, are calculated at checkout and added to the subscription charge.
- Payment processor: All payments are processed by Stripe, Inc. We do not store full card details on our servers. See our Privacy Policy for the payment data we receive.
Free Until You Rank or Get Cited (No Credit Card)
All Top3 plans use a billing-on-result model. We do not require a credit card or any payment information at signup. You will not be charged at any point unless and until any 1 of your 5 locked keywords wins on the surface you purchased: for the SEO plan, reaching position 1–3 in the Google Map Pack (the Local 3-Pack); for the AEO plan, being cited by name in ChatGPT, Gemini, or Perplexity for a query tied to your keywords; for the Both plan, the first event of either type. You must also complete the verification and billing-notice windows described below.
The billing-on-result sequence is as follows:
- Detection: A qualifying event on the surface you purchased (Map Pack top-3 placement for SEO; AI citation for AEO; either for Both) must appear in at least 3 of our daily real-device measurements within a 7-day verification window to qualify as a billable result (filters out one-off fluctuations).
- Evidence email: Automated email within 24 hours of first detection, containing the keyword, the surface (Google Map Pack or the named AI engine), a screenshot, the device fingerprint, the metro, and the timestamp.
- 7-day verification window: Customer may dispute the finding from the dashboard. Disputes trigger an independent re-run on a fresh device fleet within 2 business days.
- 14-day billing notice: After the verification window closes without sustained dispute, a billing notice email is sent. The first monthly charge (the plan price — $497 for SEO, $497 for AEO, or $797 for Both) occurs 14 calendar days after that notice. Customer may cancel during the notice period without entering payment.
- 30-day payment-entry window: If the customer does not enter payment within 30 days of the billing notice, the account is paused. Data is preserved for 90 additional days during which the customer may reactivate by entering payment.
- One free pre-billing period per customer per legal entity. Re-registering an account that previously reached billing requires entering payment information at signup.
- Pre-billing accounts are subject to the same Acceptable Use terms as paid accounts. See our Acceptable Use Policy.
How to Cancel
You can cancel your subscription in any of the following ways:
- Self-service: From the Stripe-hosted billing portal linked in your account settings. Cancellation is effective immediately at the next billing date.
- Email: Send a cancellation request to hello@top3.cloud from the email address associated with your account. We will confirm the cancellation within one business day.
Upon cancellation, your access to the Service will continue through the end of the current paid billing period. No further charges will be made. After that date, your account is suspended and your data is retained according to our data retention schedule.
Refund Policy
Top3 does not issue prorated refunds for unused portions of a paid billing period. Because the unpaid evaluation period continues until a qualifying result occurs on the surface you purchased (no credit card required to start), we believe you have sufficient opportunity to evaluate the Service before any payment is made.
The circumstances in which we issue refunds are:
- Free-until-you-rank mechanic (no refund needed): Top3 plans do not charge any payment method until any 1 of your 5 keywords wins on the surface you purchased (Map Pack for SEO; ChatGPT/Gemini/Perplexity citation for AEO; either for the Both plan), AND the verification + billing-notice windows described in the Guarantee Terms have closed without dispute. There is therefore no pre-billing money to refund. You may cancel at any point during the 14-day billing-notice window without entering payment. Refund requests after billing begins are governed by the Billing Errors and Material Service Failure clauses below.
- Billing errors: If you were charged incorrectly (duplicate charge, wrong amount, charge after cancellation), we will refund the disputed amount in full upon verification. Email hello@top3.cloud with the charge ID.
- Material service failure: If the Service is unavailable for more than 72 consecutive hours within a billing period as a result of our infrastructure (not upstream third-party events such as Google or AI platform algorithm changes), you may request a credit on the next invoice. This credit is prorated to the outage duration.
- Discretionary refunds: We reserve the right to issue refunds at our sole discretion in other circumstances. Discretionary refunds do not establish a precedent or entitle any customer to a similar refund in the future.
Refunds are issued to the original payment method. Processing time depends on your card issuer (typically 5–10 business days).
Failed Payments and Retries
If a scheduled subscription charge fails (declined card, expired card, insufficient funds), Stripe will automatically retry the charge on the following schedule:
- First retry: 3 days after the failure
- Second retry: 5 days after the first retry
- Third retry: 7 days after the second retry
You will receive an email notification after each failed attempt. If all three retries fail (approximately 21 days after the original failure), your account will be suspended and access to the Service will end. Your data is retained for 90 days during which you may reactivate the account by updating your payment method.
Disputed Charges and Chargebacks
If you have a concern with a charge, please contact hello@top3.cloud before initiating a dispute with your bank or card issuer. We resolve billing concerns within one business day and can issue corrections directly to the original payment method.
Chargeback policy. If you initiate a chargeback or payment dispute instead of contacting us for a resolution, Top3 may, at our discretion:
- Immediately suspend your account pending the dispute outcome
- Charge a $25 processing fee per disputed transaction (passed through from the payment processor) if the dispute is resolved in our favor
- Terminate the account and delete associated data after the dispute is resolved
A chargeback resolved in our favor does not entitle you to continued use of the Service. Accounts with a history of chargebacks may be refused future service.
Service Delivery
The Top3 Service is a digital subscription delivered over the internet. There is no physical shipment. The following delivery commitments apply:
- Account provisioning: Accounts are provisioned immediately on signup. You can log in and access your dashboard within minutes — no payment is required to begin.
- Ranking work begins: Once your 5 keywords are confirmed during onboarding, our device farm begins generating ranking signals for your business within 24 hours.
- Ongoing measurement: Your Map Pack ranking position and AI citation status are measured daily from real devices and reported in your dashboard.
If the Service is not delivered within the timeframes above due to our infrastructure, contact hello@top3.cloud for a resolution.
Price Changes
We may change our subscription prices. If we do, we will give you at least 30 days' notice before the new price takes effect for your subscription. You may cancel before the new price is applied. Continued use of the Service after the notice period constitutes acceptance of the new price.
Changes to This Policy
We may update this Policy from time to time. When we make material changes, we will post the updated Policy with a new "Last Updated" date and notify account holders by email. Material changes apply only prospectively.
